myFaxxer Terms of Service

By using myFaxxer (“the app”), you agree to the following terms. The app is a personal project developed and operated by Greg Roy. Use at your own risk.

1. What the app does

myFaxxer sends a PDF you provide to a phone number you specify as a fax transmission. Each send consumes one fax credit, which you purchase through Apple's In‑App Purchase system. The app relays your submission to a third‑party telecom provider (currently SignalWire) who places the call over the public telephone network.

2. Not for protected data

myFaxxer is not suitable for protected health information (PHI), personally identifiable information that falls under HIPAA, PHIPA, GDPR sensitive categories, or any similar regulated framework. The app does not carry the compliance controls, audit trails, or data‑processing agreements required for such use. If your content is regulated, do not use this app.

3. Permitted use

You are solely responsible for the content you transmit and for ensuring:

• The recipient has consented to receive faxes from you (per TCPA in the U.S., CASL in Canada, or your local anti‑spam rules).
• The content is lawful in both your jurisdiction and the recipient's.
• You hold all rights necessary to transmit it.

The app is provided for one‑to‑one sends, not bulk or broadcast faxing.

4. Credits and purchases

Credits are consumable in‑app purchases managed by Apple. They are redeemed when a fax job is accepted by our backend, not when the fax is ultimately delivered. If a fax fails after acceptance (wrong number, recipient offline, line busy), that credit has been spent — this mirrors how telecom providers bill per attempt, not per delivery. Credits do not expire, have no cash value, and are non‑transferable. Refunds are handled exclusively through Apple's App Store refund process.

5. Availability

The backend runs on personal infrastructure. Availability is best‑effort; there is no SLA. The service may be interrupted or discontinued at any time. Unused credits are not guaranteed to remain usable if the app is discontinued.

6. Liability

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. THE OPERATOR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO FAILED TRANSMISSIONS, LEGAL CLAIMS FROM RECIPIENTS, OR LOSS OF CONTENT. Total cumulative liability is limited to the amount you paid in the preceding three months.

7. Prohibited content and abuse

You may not use myFaxxer to send unsolicited commercial faxes, content that violates TCPA/CASL, harassing material, illegal content, or anything the operator determines — at sole discretion — to be abusive. Abuse may result in account suspension without refund and reporting to authorities where required by law.

9. Changes

These terms may be updated. The updated version lives at this URL; your continued use of the app after an update constitutes acceptance.
